2. General Information on Data Processing

As a rule, this website can be used without providing personal data. Where personal data is collected on this website, this is always done on a voluntary basis. This data will not be passed on to third parties without your explicit consent.

The processing of personal data on this website is based on the statutory provisions of the GDPR. The legal bases considered in particular are:

  • Art. 6 para. 1 lit. a GDPR - Consent
  • Art. 6 para. 1 lit. b GDPR - Performance of a contract or pre-contractual measures
  • Art. 6 para. 1 lit. c GDPR - Compliance with a legal obligation
  • Art. 6 para. 1 lit. f GDPR - Legitimate interests

3. Server Log Files

This website is hosted on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. Each time this website is accessed, information is automatically stored in server log files that the browser transmits automatically:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the retrieved file
  • Website from which the access originates (referrer URL)
  • Browser and operating system used
  • Volume of data transferred

This data is not merged with other data sources. The legal basis for data processing is Art. 6 para. 1 lit. f GDPR. The legitimate interest lies in the technical operation of this website and the detection and defence against attacks. Log data is deleted after a maximum of 7 days.

Hetzner processes data within the EU. Further information on data protection at Hetzner is available at https://www.hetzner.com/de/legal/privacy-policy.

4. Contact Form and Email Contact

If you use the contact form on this website or contact us by email, the data submitted, including the contact details provided, will be stored for the purpose of processing your enquiry. I will not pass this data on without your consent.

The processing of data entered in the contact form is based on Art. 6 para. 1 lit. b GDPR, provided the enquiry is related to the initiation or performance of a contract. In all other cases, processing is based on my legitimate interest in the effective handling of enquiries received (Art. 6 para. 1 lit. f GDPR).

The data entered in the contact form will remain with me until you request deletion, withdraw your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions - in particular retention periods - remain unaffected.

4a. Contact via WhatsApp

On some pages I offer WhatsApp as an additional, fast way to get in touch. WhatsApp is a service provided by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland. If you contact me via WhatsApp, your phone number, your WhatsApp profile name and the content of your message are processed in order to handle your enquiry.

Using WhatsApp is voluntary and happens on your own initiative. The legal basis is Art. 6 para. 1 lit. b GDPR where the enquiry relates to a contract, as well as my legitimate interest in a low-threshold contact channel (Art. 6 para. 1 lit. f GDPR); by actively contacting me you also consent to the processing (Art. 6 para. 1 lit. a GDPR).

I have no influence on the data processing by WhatsApp itself - including a possible transfer of data to the USA; the privacy policy of WhatsApp/Meta applies (see whatsapp.com/legal/privacy-policy-eea). If you wish to avoid this, please use one of the other contact channels (contact form, email or phone). The data you send via WhatsApp remains with me until the purpose no longer applies or you request deletion.

5. Cookies and Storage Technologies

This website uses technically necessary cookies and local storage technologies (localStorage) that are required for proper operation - for example, to store your accessibility mode preference. These cannot be disabled, as certain website functions would not work without them. No cookies beyond this, in particular for marketing or tracking, are used.

The legal basis for technically necessary cookies and local storage technologies is § 25 para. 2 no. 2 TDDDG (formerly TTDSG) in conjunction with Art. 6 para. 1 lit. f GDPR. A cookie banner is not required, as this website does not use any cookies or tracking methods that require consent.

5a. Web Analytics with Umami (cookieless)

For anonymous traffic analysis, I use Umami, a privacy-friendly open-source analytics tool that I run myself on my own server in Germany (EU). Umami does not set cookies, does not store any information on your device, and does not create an individual user profile. There is no recognition of individual visitors across multiple sessions or websites (cross-site tracking).

Only aggregated, anonymous usage data is collected: pages visited, the source of the visit (referrer), the approximate country, and device type and browser. Your IP address is used only briefly to calculate a daily rotating, non-traceable hash value and is not stored afterwards. It is therefore not possible to draw any conclusions about your identity.

The legal basis for using Umami is Art. 6 para. 1 lit. f GDPR (legitimate interest in anonymous, privacy-friendly traffic analysis to improve this website). Since no cookies are set and no personal data is processed, no consent is required under § 25 TDDDG - a cookie banner is therefore not necessary. Processing takes place exclusively on my own server; no data is passed on to third parties.

If your browser sends a "Do Not Track" signal, this is respected by Umami and the respective page view is excluded from the statistics. Since no personal data is stored in any case, no further objection is required; however, you can object to the recording of your visit informally by email at any time.

6. SSL/TLS Encryption

For security reasons and to protect the transmission of confidential content, this website uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the browser address bar changes from "http://" to "https://" and by the padlock symbol in your browser bar.

When SSL/TLS encryption is activated, the data you transmit to me cannot be read by third parties.

7. Your Rights

You have the following rights with regard to the personal data concerning you:

  • Right of access (Art. 15 GDPR): You have the right to obtain information about the personal data I hold about you.
  • Right to rectification (Art. 16 GDPR): You have the right to request the correction of inaccurate data or the completion of incomplete data.
  • Right to erasure (Art. 17 GDPR): You have the right to request the deletion of your personal data stored with me, provided no statutory retention obligation applies.
  • Right to restriction of processing (Art. 18 GDPR): You have the right to request the restriction of the processing of your personal data.
  • Right to data portability (Art. 20 GDPR): You have the right to receive your personal data in a structured, commonly used, and machine-readable format.
  • Right to object (Art. 21 GDPR): You have the right to object at any time to the processing of your personal data, provided the processing is based on Art. 6 para. 1 lit. e or f GDPR.

To exercise your rights, please contact: info@emit-solution.com

8. Right to Lodge a Complaint with a Supervisory Authority

You have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data. The competent supervisory authority for Thuringia is:

Thüringer Landesbeauftragter für den Datenschutz und die Informationsfreiheit
(Thuringian State Commissioner for Data Protection and Freedom of Information)

Häßlerstraße 8
99096 Erfurt
Phone: 0361 57-3112900
E-Mail: poststelle@datenschutz.thueringen.de

9. Changes to this Privacy Policy

I reserve the right to update this privacy policy to ensure it always complies with current legal requirements or to reflect changes to my services, e.g. when introducing new services. The updated privacy policy will apply to your next visit.
